These Terms of Service ("Terms") govern your use of the Pulse Edit and Beat Markers software products ("Software") and the pulseedit.com website ("Website"), provided by AB Tools / Abramo Benedetti ("we", "us", "our").
By using our Website or Software, you agree to these Terms. If you do not agree, do not use our products.
1. License
When you purchase a license for our Software, we grant you a perpetual, non-exclusive, non-transferable, single-user license to use the Software on the number of computers specified by your license tier (1, 2, or 5).
- The license is tied to you as an individual. You may not share, resell, sublicense, or transfer your license key to another person.
- Each license allows installation on the specified number of computers owned or controlled by you.
- The license includes all future updates and new features at no additional cost.
2. Free Trial
Our Software includes a free trial with limited uses (3 uses for Beat Markers, 4 uses for Pulse Edit). The trial provides full functionality with no credit card required. Trial uses are counted per device.
3. Payments and Refunds
All payments are processed by Stripe, Inc. We do not store or have access to your full payment card details.
Refund requests are handled on a case-by-case basis. Since our Software includes a free trial, we encourage you to try before purchasing. If you experience a technical issue that prevents the Software from functioning, contact us at support@pulseedit.com.
EU consumers — 14-day right of withdrawal: EU consumers have a 14-day right of withdrawal for digital goods. By starting the free trial and accepting these Terms, you acknowledge that the digital service begins immediately and waive the 14-day withdrawal right per EU Directive 2011/83/EU.
4. Intellectual Property
Our IP: All intellectual property rights in the Software, Website, and related materials (code, design, documentation, branding) are owned by AB Tools. You may not decompile, reverse-engineer, modify, or redistribute the Software.
Your content: You retain full ownership of all videos, audio, and other content you create using our Software. We claim no rights over your creative output.
5. Acceptable Use
You agree not to:
- Share, distribute, or publish your license key
- Attempt to bypass license validation or trial limits
- Decompile, reverse-engineer, or modify the Software
- Use the Software for any unlawful purpose
6. Limitation of Liability
The Software is provided "as is" without warranties of any kind, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement.
To the maximum extent permitted by law, AB Tools shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Software or Website, including but not limited to loss of data, loss of profits, or business interruption.
Our total liability for any claim related to these Terms shall not exceed the amount you paid for the Software.
7. Service Availability
We do not guarantee any specific uptime or service level agreement (SLA) for our Website or license validation servers. We make reasonable efforts to keep services available but may perform maintenance or updates at our discretion.
Software updates and new features are provided at our discretion and are included free with your license.
8. Termination
We reserve the right to revoke your license if you violate these Terms, including but not limited to sharing license keys, attempting to circumvent license validation, or redistributing the Software.
Upon termination, you must stop using the Software and delete all copies.
9. Privacy
Your use of our Website and Software is also governed by our Privacy Policy, which describes how we collect and use your data.
10. Changes to These Terms
We may update these Terms from time to time. Changes will be posted on this page with an updated "Last updated" date. Continued use of the Software or Website after changes constitutes acceptance of the updated Terms.
11. Governing Law
These terms are governed by the laws of Italy, where AB Tools is registered. EU consumers retain rights under their home jurisdiction's consumer protection laws and may use the EU ODR platform at https://ec.europa.eu/consumers/odr/.
